La magistratura non sembra particolarmente interessata alla tutela del bene pubblico
I rapporti tra il Comitato Spontaneo per la Difesa di Venezia e la Magistratura veneziana iniziano con un esposto (cui segue a breve termine una denuncia) presentato dall'ing. Lino Pavan che verte sulla sparizione dei 14.000 masegni dall'insula degli Ormesini. L'ing. Pavan, prima del pensionamento, aveva ricoperto incarichi di rilievo precisamente nel settore dei lavori pubblici. I suoi atti giudiziari sono molto tecnici e circostanziati, la sua conoscenza di specifiche e contratti d'appalto è professionale, e le contravvenzioni ai capitolati d'appalto che rileva sono ben documentate. In seguito a queste denunce, l'apparato esecutivo dello stato avvia indagini per mezzo di un vigile urbano distaccato presso la sede della Procura. Questo viglie raccoglie parte del materiale collezionato dal Comitato e interroga alcuni dei suoi promotori, fra cui il sottoscritto. Personalmente, esco dal primo colloquio con questo vigile con la sensazione (un ammicco di qua, un'allargare di braccia di là...) che l'apparato giudiziario non possa o non voglia affatto intervenire in una questione che coinvolge interessi economici e politici tanto rilevanti. La sensazione si preciserà nel corso di seguenti incontri con l'investigatore, che si fà di volta in volta meno partecipe del problema, con silenzi e risposte vaghe alle domande rivolte dai membri del Comitato. La sensazione diviene realtà con la decisione del magistrato incaricato di archiviare esposto e denuncia. Nel frattempo, ho a mia volta presentato denuncia per il raid vandalistico contro le colonnine in pietra d'Istria di fondamenta dei Tolentini, che a mio modo di vedere è volto a far sparire le prove del furto e sostituzione di numerose colonnine. Proprio in quei giorni l'evidenza di quel malaffare veniva mostrata nel corso di un'esposizione allestita dal Comitato. Questa denuncia era corredata di ampia documentazione fotografica, più ampia di quella che presentiamo in questo sito, e manifestava anche il pericolo per i passanti costituito da una pesante recinzione in pietra e ferro resa barcollante dal danneggiamento. Naturalmente, prima di esporre i fatti alla magistratura, avevo effettuato tentativi di interessare la Sovrintendenza ai beni architettonici, con rapporti dettagliati e documentazione fotografica, senza ricevere alcuna risposta ufficiale ma solo alzate di spalle. Personalmente, esco dal primo colloquio con questo vigile con la sensazione (un ammicco di qua, un'allargare di braccia di là...) che l'apparato giudiziario non possa o non voglia affatto intervenire in una questione che coinvolge interessi economici e politici tanto rilevanti. La sensazione si preciserà nel corso di seguenti incontri con l'investigatore, che si fà di volta in volta meno partecipe del problema, con silenzi e risposte vaghe alle domande rivolte dai membri del Comitato.
La sensazione diviene realtà con la decisione del magistrato incaricato di archiviare esposto e denuncia.
Nel frattempo, ho a mia volta presentato denuncia per il raid vandalistico contro le colonnine in pietra d'Istria di fondamenta dei Tolentini, che a mio modo di vedere è volto a far sparire le prove del furto e sostituzione di numerose colonnine. Proprio in quei giorni l'evidenza di quel malaffare veniva mostrata nel corso di un'esposizione allestita dal Comitato.
Questa denuncia era corredata di ampia documentazione fotografica, più ampia di quella che presentiamo in questo sito, e manifestava anche il pericolo per i passanti costituito da una pesante recinzione in pietra e ferro resa barcollante dal danneggiamento.
Naturalmente, prima di esporre i fatti alla magistratura, avevo effettuato tentativi di interessare la Sovrintendenza ai beni architettonici, con rapporti dettagliati e documentazione fotografica, senza ricevere alcuna risposta ufficiale ma solo alzate di spalle.

Communications between the Venice Defence Committee and the Venetian Court began with an exposition of the problem (followed by a formal denouncement) presented by engineer Lino Pavan, concerning the disappearance of more than 14,000 "masegni" during the period of works on insula degli Ormesini". Eng. Pavan, now retired, worked as a prominent supervisor of public works. His submissions to the court are detailed and very technical. His professional knowledge of specifications and contracts put out for public tender underpins those infractions to contracts which he has pointed out; all of these are well documented. After this denouncement, the executive of the state apparatus began its investigation by appointing a local policeman serving with the Procura della Repubblica. This guard has asked for and copied some of the evidence collected by the Venice Defence Committee, and has examined several Committee members, including myself. Personally, from my initial interview with the guard I had the feeling - a wink here, arms opening wide there - that the Court Apparatus cannot, or will not, interfere in a question involving large political and economic interests. This feeling increased during further interviews with this gentleman, during which he seemed to lose interest in the problem, supplying only silence or offhand answers to the questions posed by the Committee. Eventually this feeling was substantiated when Mr. Ramacci, the Judge in charge of the investigations (or so I was informed by the guard) decided to dismiss the process. In the main time, I have myself presented a denouncement of the raid on the small Istrian stone columns of the rail in fondamenta dei Tolentini, where I infer a will to hide material evidence of the theft of several columns. At the same time, photographic evidence of that awful affair were shown in an exposition organised by the Venice Defence Committeee. That denouncement was accompanied by a large portfolio of photographic documentation, far bigger than the one published on this site. It also pointed out the daily dangers to the pedestrians posed by hundreds of metres of heavy rail made insecure following the damage. Before presenting this to the Court, I had attempted to inform the Architectural Goods Sovrintendence, but received no official answers other than shoulder-shrugging from its functionaries.
